MapMyWater Terms of Service

These Terms are a binding agreement between you and the person or entity identified as the seller in your checkout confirmation, receipt, invoice, or signed order form, operating under the trade names Map My Water and MapMyWater (“Map My Water,” “we,” “us,” or “our”). The seller’s exact legal name and notice address must be included in that retained transaction record. By creating an account, affirmatively accepting these Terms, accepting an order form, or using the Service, you agree to these Terms and acknowledge the Privacy Policy. If acting for an organization, you represent that you have authority to bind it.

Eligibility and Service

You must be at least 18 and legally able to contract. The Service is designed for business/professional field documentation, not personal/household use. Keep accounts and sign-in links secure. The Service supports project records, maps, photos, exports, and read-only sharing. Features/limits may change; no SLA applies unless signed separately.

Critical map and excavation safety notice

All maps, markers, coordinates, drawings, imagery, distances, and measurements are approximate documentation aids, not survey-grade, and may be materially inaccurate due to GPS, imagery, geocoding, user placement, age, or field conditions.

Map My Water is not a utility-locate, surveying, engineering, construction-staking, or as-built service and does not detect or establish the presence, absence, identity, depth, or position of any buried facility or hazard.

Do not use the Service to decide where it is safe to dig or as the sole basis for emergency, shutoff, repair, construction, code, or safety decisions. Before excavation, contact 811/the applicable one-call center, comply with ticket/marking/law requirements, use qualified professional services when required, and verify field conditions.

Accounts and responsibilities

You are responsible for authorized users, legality/accuracy of Customer Data, upload permissions, and decisions/actions based on it. Maintain professional judgment and independent backups; do not upload unnecessary sensitive/regulated data.

Customer Data

You retain ownership of submitted project content. You grant Map My Water/providers a worldwide nonexclusive license to host, copy, transmit, display, modify, back up, and process it only as reasonably needed to provide, secure, support, improve, and comply with law for the Service. You represent you have required rights. You control share links/exports. We may restrict unlawful, unsafe, infringing, malicious, or out-of-scope content.

Plans, payment, and automatic renewal

Free and paid plan limits/prices are displayed in the Service. Checkout or a signed order form controls the exact price, frequency, taxes, and quantity. Paid subscriptions automatically renew for successive displayed periods and the saved payment method is charged until cancellation. We present recurring terms before purchase and obtain affirmative consent. You authorize Stripe/us to process recurring charges/taxes. Future price changes receive legally required notice.

Cancellation and refunds

Cancel through the Stripe billing portal or contact support if unavailable. Cancellation stops future renewals and normally leaves access through the paid period; it does not automatically refund a processed charge. Duplicate, billing-error, unauthorized-after-verification, and confirmed material access-failure requests are reviewed under the Cancellation and Refund Policy.

Acceptable use

Do not violate law/rights; upload without authority; expose credentials/other customer data; distribute malware; bypass security/limits; scrape/overload; reverse engineer except where restriction is prohibited; resell without approval; facilitate harm/unlawful surveillance; represent outputs as certified surveys/locates; or use the Service beyond its documented high-risk purpose. We may investigate/restrict suspected violations.

Intellectual property and feedback

We/licensors own the Service, software, designs, documentation, and marks, excluding Customer Data. We grant a limited nonexclusive nontransferable revocable use right during authorization. Nonconfidential feedback may be used perpetually, worldwide, transferably, sublicensably, and royalty-free without identifying you or using Customer Data.

Third-party services

The Service depends on providers including Stripe, Supabase, Vercel, Resend, Google, Mapbox, and OpenStreetMap/Nominatim. Their services/data/imagery/attribution/terms may apply; we do not control their availability or accuracy.

Suspension and termination

We may suspend/terminate for breach, nonpayment, security risk, unlawful conduct, abuse, legal requirement, or protection of users/systems, with reasonable notice/cure where appropriate. Export needed data. Retention follows Privacy, contract, holds, and backups. Payment, IP, disclaimer, liability, indemnity, and dispute sections survive.

Disclaimers

TO THE MAXIMUM LAWFUL EXTENT, THE SERVICE IS “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED MERCHANTABILITY, FITNESS, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND COURSE-OF-DEALING WARRANTIES. WE DO NOT WARRANT UNINTERRUPTED, ERROR-FREE, SECURE, PRESERVED, OR PARTICULARLY SUITABLE SERVICE/DATA. NONWAIVABLE WARRANTIES REMAIN.

Limitation of liability

TO THE MAXIMUM LAWFUL EXTENT, MAP MY WATER, ITS OWNERS, PERSONNEL, AND PROVIDERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFIT, REVENUE, BUSINESS, DATA, OR GOODWILL; SUBSTITUTE SERVICES; OR CLAIMS FROM RELIANCE ON APPROXIMATE MAPS, EXCAVATION, UTILITY STRIKES, PROPERTY DAMAGE, OR FIELD OR SAFETY DECISIONS.

TO THE MAXIMUM LAWFUL EXTENT, OUR TOTAL LIABILITY ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE FEES YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR US$100. This limitation does not apply to liability that cannot lawfully be limited or to a different cap expressly stated in a signed order form.

Indemnification

To the lawful extent, you will defend, indemnify, and hold harmless Map My Water/owners/personnel/providers from third-party claims/costs arising from Customer Data, missing rights/permissions, misuse, violation, or excavation/field/property/safety decisions, subject to reasonable notice/cooperation and settlement protections.

Law and disputes

California law governs except mandatory law. Before filing, give notice and attempt good-faith resolution for 30 days. Subject to nonwaivable rules, proceedings belong in an appropriate California state/federal court. These Terms impose no mandatory arbitration or class waiver.

General

These Terms, the Privacy Policy, the checkout disclosures, and any signed order form or DPA form the agreement. A signed order form controls only an express conflict concerning that order. You may not assign the agreement without our written consent, except in connection with a permitted transfer of substantially all relevant assets; we may assign it in connection with a merger, financing, reorganization, or sale of the business or relevant assets. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A waiver must be written and applies only to the stated instance. Neither party is liable for delay caused by events beyond reasonable control, except payment obligations. Electronic acceptance, signatures, and counterparts are effective.

Changes and contact

Material updates receive legally required or appropriate notice and do not retroactively change an accrued dispute. Renewed affirmative consent will be requested when required. Contact support@mapmywater.com. Formal notices to Map My Water must also use the legal name and notice address shown in the applicable checkout confirmation, receipt, invoice, or order form.
